In Timbs v. Indiana, the United States Supreme Court was called upon to decide whether the Eighth Amendment’s Excessive Fines Clause—which provides that “excessive fines” shall not be “imposed”—applies to state and local governments. In connection with the Timbs case, Cades Schutte attorney David Schulmeister filed an amicus curiae brief on behalf of a group of prominent law professors whose scholarship focuses on the history of the Eighth Amendment. Justice Ginsburg’s opinion for the Court in Timbs, which was issued in February 2019, cited and quoted from the Cades Schutte brief.
